By accessing our website and/or using our services, you agree to abide by the following terms and conditions.

DEFINITIONS

CLIENT:

The term “CLIENT” shall refer to the buyer or as listed on the AGREEMENT.

AGENCY:

The term “Agency” shall collectively refer to Elite Visuals Production LLC, a Florida Limited Liability Company and any and all agents and/or subcontractors of Elite Visuals Productions LLC.

EVENT:

The term “EVENT” shall include the Ceremony, the Reception, and any other events indicated by Client.

AGREEMENT:

At all times, this written contract shall be known as the “AGREEMENT”. The AGREEMENT represents the full and complete understanding between CLIENT and Agency with respect to the subject matter herein. The AGREEMENT supersedes all prior negotiations, representations, and statements between CLIENT and AGENCY concerning the subject matter herein.

TERMS

Production Schedule.

Shortly before the event, a team member will call the CLIENT from the Agency. When you submit the production schedule for the day, you will have another opportunity to specify any things you do or don’t want done on the event day. Please let us know of any details you have now (rough timelines are fine). We will try to accommodate all requests as best as we can. Due to the nature of live events, in some instances requests or plans that seem reasonable before an event, may turn out to too difficult to accomplish based on the actual course of events that take place.

Pre-Edit Form.

Upon signing this AGREEMENT, the CLIENT submits its wishes regarding the edit. The AGENCY is typically able to accomplish all requests, however, at times we are not. Ultimately, Agency will do it’s best to edit the film in accordance with our creative judgment. Please make your song choice(s) available to us before the event. The number of song selections should correspond to the number of songs you get in the edit package (one song for a one-song edit).

Deposit and Cancellation Policy.

Agency requires deposits to be made in two separate installments:

First Installment:

The first installment of 50% (Fifty Percent) of the agreed price will book Agency, activating the AGREEMENT. This initial deposit must be tendered along with the signed AGREEMENT.

Second Installment:

The remaining balance as outlined in the AGREEMENT will be due by event date.
* If Agency agrees to an installment plan, all installments must be paid 1 day before event date.

Note: After final product is received, further changes or services requested by CLIENT will be billed at an hourly rate of 100$/hr.

Refund and Cancellation Policy.

In the event of a CLIENT-initiated cancellation, the client’s first installment will not be refunded to CLIENT.

In the event of a CLIENT-initiated postponement, all deposits paid by CLIENT to Agency may be transferable to CLIENT’s new event date provided. Agency can accommodate client’s new date. Although Agency will use its best efforts to provide services on CLIENT’s new date, Agency is under no obligation to accommodate CLIENT’s new date if doing so will conflict with Agency’s other professional obligations. If new date is not available for Agency to cover, then Agency deposit will remain non-refundable.

In the event of an Agency-initiated cancellation, Agency shall refund to CLIENT the total amount of all deposits paid to Agency. In such an event Agency shall have no further liability to the client.

Wedding Day Coverage.

The Client is solely responsible for securing permission from the site owner/operator for use of the production site as well as authority for Agency to set up all necessary production equipment.  It is understood that the quality of the production is dependent upon adequate lighting, camera/microphone positions, and other conditions not under the control of Agency.

Agency is not responsible for poor audio if the groom does not agree to wear a lapel microphone, dark or grainy video resulting from inadequate lighting or the refusal of the client to allow camera-top lighting at the reception, or electrical or mechanical malfunctions on location that are beyond our control.

Agency reserves the right to discontinue photographing or videotaping in any situation (ex: rain, extreme temperatures, humidity, hazardous locations) that could put the safety of the cameraman or equipment at risk.

Agency will do it’s best to follow the Production Schedule as planned, however wedding day schedules tend to shift and events planned may occur later than initially planned. In the event of a schedule shift, we will do our best to adjust accordingly using our best professional judgement. Based on our experience, we prefer to arrive at the ceremony location one hour before the ceremony start time to assure we are ready. This hour of set up time is included in the total hours of coverage. This time may fluctuate based on the specific plans and maybe be less than an hour, but is subject to the professional judgement of the Agency.

Meal Arrangements.

There’s no obligation to provide a meal for the camera operator(s) on the event date unless if Client desires to do so.

Liability.

Any liability for any accidents, injuries or damages directly or indirectly caused by Agency or a subcontractor of Agency will be held by Agency’s insurer. CLIENT and Agency hereby mutually hold each other harmless for any damages including, but not limited to error, loss, injury, damage and dissatisfaction resulting from any acts or omissions by Agency or CLIENT or any of their respective agents, employees or contractors, family, friends, guests and any other parties associated with CLIENT or Agency.

Agency and CLIENT will not be held liable for any mechanical, technical or otherwise uncontrollable and/or unforeseen events that influence the production process. The liability of Agency in the event of uncontrollable and/or unforeseen or unintentional circumstances shall be limited the amount of all deposits paid to Agency by CLIENT. CLIENT and Agency mutually agree not to disparage or act in a way to directly, indirectly negatively impact each other. Agency will not be held liable for any other accidents, injuries or damages directly or indirectly caused by Agency or a subcontractor of Agency.

Editing.

We typically estimate that the editing process will take 1 months once we receive the music and PRE-EDIT FORM from CLIENT. This is an estimate however and may be shorter or longer.

Once the edited film is completed, CLIENT will be able to view the segment for approval. If CLIENT notes any errors made by Agency (not including items Agency was not able to or chose against including based on artistic judgment), Agency will make necessary corrections to the edit. If CLIENT requests to have additional creative or discretionary changes made to the edit, CLIENT will pay for additional editing at an hourly rate of ($100) per hour. Agency will provide CLIENT with a quote for the additional work before proceeding.

When CLIENT approves, then Agency will create the final product as selected in the contract and deliver them to CLIENT. If there is no response after one month, Agency may need to proceed with finalization and delivery.

 

Final Product.

Elite Visuals Production’s main product is the unique editing. We take your requests into consideration and edit the film as we feel works best creatively.

The raw footage is the material used to create your edited film, and is in its natural form and not refined like the edited product. Agency will create the film based on your suggestions but ultimately will have the creative oversight in the product. The total running time of the final product is difficult to estimate beforehand; therefore, the total running time may vary. Also, the discussions and planning of a final product is a sketch of what the final product will look like. Since each wedding is different, each wedding video is different as well. Agency has artistic license to change and create/produce the best film possible according to the final discretion of Agency. A final product is subject to variations from the initial plan due to actual production events.

Copyrights.

The original footage remains the property of Agency. Agency owns all proprietary rights in and to the copyrightable and/or copyrighted works and has the exclusive right to license to others the right to produce, copy, make, sublicense or sell. Agency grants Client a non-exclusive, non-transferable license to use the original footage and edits without the express written permission of the Agency. Agency may use footage and edited material from the original footage to market Agency’s wedding videography services, publicly demonstrate and share the original footage and the edited material for any purpose online and offline.

Client shall not sell, grant sub-licenses or distribute the original footage or the edited materials for profit without the prior express written approval of Agency.

The client carries sole responsibility for all copyrighted music used in the wedding video edit. In no event, Agency should be liable for the copyrighted music used in Client’s video edits. Client understands that by choosing any copyrighted songs as a background music for the wedding video he/she may be held liable under the applicable copyright law.

Governing Law.

Elite Visuals Production is a Florida Limited Liability Company and this agreement and all services rendered by Elite Visuals Productions LLC are governed by the laws of Florida. Any disputes are handled in the State of Florida at a venue selected by Elite Visuals Production LLC

If you do not agree to be bound by these terms, you should leave the website immediately and refrain from using our services.
